AIFC Court Cancels Order Allowing Naftogaz to Recover Gazprom Debt

The Astana International Financial Centre Court has canceled an order that allowed Ukraine’s Naftogaz to recover more than $1.4 billion from Gazprom in Kazakhstan, Orda.kz reports.
The decision was issued on July 7, 2026, by Judge Lord Faulks KC. He canceled an earlier order by Judge Andrew Spink, who on May 15 recognized an arbitration award issued by the ICC International Court of Arbitration on June 16, 2025, and allowed it to be enforced.
The dispute between Naftogaz and Gazprom concerns a 2019 contract for the transit of Russian gas through Ukraine. After the start of the war, transit through the Sokhranovka entry point stopped. The Ukrainian side said it continued supplies through Sudzha, but Gazprom refused to pay for transit in full.
In June 2025, the ICC arbitration court in Switzerland sided with Naftogaz and ordered Gazprom to pay more than $1.4 billion in debt, interest and legal costs. Naftogaz then began seeking enforcement of the ruling in other countries. Kazakhstan was the first such jurisdiction.
Later, Kazakhstan’s Justice Ministry stressed that the country was not involved in the case.
The AIFC Court is not part of Kazakhstan’s judicial system and is not a state body. It did not consider the dispute between the companies itself. The case concerned only the recognition and enforcement of an arbitration award previously issued in Switzerland,Deputy Justice Minister Daniyar Vaisov said.
