Officer Failed to Enforce Deportation Before Gasoline Attack, Court Finds

Migration police lieutenant colonel Daniyar Adenov has been found guilty of negligence in connection with the failure to deport a Russian citizen, Orda.kz reports.
The case, which concluded in Almaty, involved the delayed enforcement of a deportation order issued against a Russian national who later attacked his former spouse, Indira Tergeubayeva.
According to court records, the man poured gasoline on Tergeubayeva and a store before setting both on fire. He died in the incident, while Tergeubayeva sustained severe burns.
According to Tergeubaeva, shortly before the incident, the Supreme Court ruled to deport him from the country. However, the migration police did not implement this decision, and he continued to threaten her.
Her appeals to the police did not bring results.
He said he would kill me. I complained several times, but nothing happened. In the end, he brought 40 liters of gasoline and set me on fire along with the store,
the victim told the court.
The court determined that Lieutenant Colonel Adenov had failed to fulfill his official duties and was negligent in enforcing the deportation order. He was found guilty under Part 2 of Article 371 of the Criminal Code of Kazakhstan but was exempted from criminal punishment due to the statute of limitations.
The court ordered Adenov to pay one million tenge in compensation to the victim. Additional claims may be pursued through a civil case.
The judge also issued two private orders to the relevant department heads and staff whose actions or inactions may have contributed to the incident's outcome.
