A Kazakhstan resident secured a full refund for a Jennifer Lopez concert ticket after taking the seller to court, Orda.kz reports. The company had tried to keep 30% of the payment.

The customer paid 376,869 tenge for the ticket through the company. After paying, however, he received neither the ticket nor a contract or receipt. He later canceled the order and requested his money back.

The company agreed to return only part of the payment, withholding 113,061 tenge. The customer contacted the Pavlodar Region Department of Trade and Consumer Protection and then filed a lawsuit.

The first court ordered the company to return 263,809 tenge but allowed it to keep 30%. The customer appealed.

The company did not provide evidence that it had incurred expenses of 113,060 tenge. The customer was informed about the 30% deduction only after making the payment, so the court did not consider that condition to have been agreed upon, the department said.

The court also found that the two sides had not signed a travel services contract. The case concerned only the purchase of a concert ticket, so the court applied the Civil Code provisions governing paid services.

The company was ordered to refund the full ticket price and cover the customer’s legal costs.
