Vostokmashzavod Disputes Railcar Downtime Charges from KTZ-Freight

The company Vostokmashzavod (VMZ) has filed a complaint against KTZ-Freight Transportation LLP, which had been charging it for railcar downtime since 2022, Orda.kz reports.
According to legal regulations, VMZ was not responsible for these charges, as it was not acting as the shipper, consignee, or railcar owner.
Under the Law on Railway Transport, responsibility for downtime lies with shippers, consignees, and owners of rolling stock or infrastructure. At the time of the claims, VMZ did not fall into any of these categories and was not obligated to pay related fees or penalties,
the transport oversight agency clarified.
Despite this, the national railway company continued to apply penalties, which eventually amounted to four billion tenge.
The unlawful actions of KTZ-Freight resulted in an unjustified debt and a violation of the investor’s rights. Following a submission from the Main Transport Prosecutor’s Office, the unjustified charges were removed,
the agency added.
