Transcript, Motion Against Witnesses, and Civil Claim: Key Developments in Sherzat Polat Case

At the latest court session concerning the death of Sherzat Polat, several procedural developments took place, Orda.kz reports.
"We've Jumped Too Much. The Cup Is Overflowing."
This statement, made by one of the defendants and captured on a car’s dashcam the night of the incident, was read aloud in court by the victims’ lawyer, Meirman Shekeyev.
According to the transcript, the accused appeared calm and informal in tone following the altercation.
Defense lawyer Bagdagul Azhigaliyeva questioned the accused, Nurkiyas Ilyasov and Abzal Shynasyl, about their conversation in the car. They responded with:
“I don’t remember”, “We didn’t discuss it”, “We didn’t agree."
Motion Against Witnesses
The defense submitted a motion requesting legal action against witnesses Elmira Nurbekova and Dana Zhaksygeldy. Attorney Meirman Shekeyev argued that, despite being in the vehicle at the time, the witnesses testified in court that they "heard nothing," which he characterized as obstruction.
We ask that a private ruling be issued against Elmira Nurbekova for knowingly giving false testimony in court and for failing to report the commission of a particularly serious crime, and that this ruling be sent to the Almaty Region Prosecutor for the adoption of an appropriate procedural decision. In addition, we ask that a similar private ruling be issued against witness Dana Zhaksigeldi,
Shekeyev stated.
Prosecutors indicated they would respond to the motion during closing arguments. Judge Yerzhan Zhanuzakov ultimately dismissed the request.
Claim for Compensation
The family of Sherzat Polat submitted a civil claim for material and moral damages.
The claims include:
- 2,794,000 tenge for funeral-related expenses, to be paid to the victim’s father, Karzhaubai Nurymov.
- 100,000,000 tenge in moral damages from Abzal Shynasyl and Ravil Sakiev, to be distributed among:
- Karzhaubai Nurymov (father)
- Gulbara Beishembaeva (mother)
- Zhumabike Kadirova (relative)
120,000,000 tenge in moral damages from the following individuals:
- Shyngys Belgozhayev
- Darkhan Yeskentayev
- Nurkiyas Ilyasov
- Azamat Toktaubayev
- Nurbol Toktaubayev
- Didar Kaliyahmet
The total amount of the civil claim exceeds 660 million tenge. The court has accepted the petition.
Request for Reclassification Denied
Lawyers for the victim’s family also requested that the case be returned for further investigation and reclassified as a group homicide. Currently, Abzal Shynasyl is the only defendant formally charged with fatally stabbing Sherzat Polat.
The prosecution opposed the motion, and the judge declined the request.
Court proceedings are scheduled to continue on June 2 with the beginning of closing arguments. Orda.kz will continue to monitor the trial.
