Maykainzoloto: Compensation for Rescuer's Relatives Reduced

Oleg Tyshkevich's family filed a lawsuit against the employer, demanding 120 million tenge in compensation for moral damages. However, the court changed the decision, Orda.kz reports, citing the Pavlodar Regional Court's press service.
The man was on a bus with four rescue workers who died in January of this year. His mother, daughter, son, and sister filed litigation asking for compensation for moral damages. The court satisfied their claim and ordered the employer to pay 30 million tenge each, totaling 120 million tenge.
However, during the retrial on November 13, 2024, the Pavlodar Regional Court reduced the compensation amount – 7.5 million tenge for each plaintiff.
When determining the amount of compensation for moral damage, the court of first instance was guided by the Act on an accident related to work activity, the act of a special investigation of the circumstances of the accident, which established 100% fault of the employer. Meanwhile, the court did not take into account that the accident was related to the production activities of JSC "Maikainzoloto'
explained in court.
The investigation showed that the incident occurred due to poor safety control at the plant and the lack of design documentation.
Considering all the circumstances, the Pavlodar Regional Court changed the compensation amount.
The decision has entered into legal force.
