The trial of Khasan Kasymbayev continues in the Talgar district of Almaty region. Judge Ainagul Tukibayeva barred journalists from the courtroom and prohibited publication of the testimonies of victims and witnesses. Orda.kz reports on the latest hearing.
Trial participants voiced dissatisfaction with journalists publishing the victim’s testimony.
After the hearing, videos from the courtroom were posted on social networks. In this regard, until the end of the trial, it is prohibited to disclose the testimony of the victims and other participants in the process, said Ainagul Tukibayeva.
The media nonetheless observed the proceedings via live stream.
Defense lawyer Yerlan Mendeshev, representing Khasan Kasymbayev, challenged the judge, accusing her of bias. He argued that all defense motions were rejected. The court, however, dismissed Mendeshev’s petition.
The defendant’s wife, Zulfiya Kasymbaeva, said the defense wanted the media present so the trial would be as open as possible:
I was surprised. First of all, I was shocked that the journalists were sent out. Our side, on the contrary, wanted them to be present so the public would understand what was going on. In addition, our lawyers filed four motions, but the judge did not grant any of them. After that, a recusal was filed. I thought another judge would come and listen to both sides, but this did not happen.
The hearing was then adjourned due to the health of defendant Ruslan Aliyev, who required an ambulance and was taken away. The trial was postponed.
To recall, after the death of Sherzat Polat, rumors spread in Talgar about the Khutor organized crime group and Kasymbayev’s role in it. He has denied the accusations, saying “his conscience is clear.”
Kasymbayev was arrested in November 2024, and the investigation was completed in the summer of 2025. On July 29, the prosecutor’s office transferred the case to court.
Orda.kz continues to follow the process.
