The National Security Committee (KNB) has responded to inquiries about a Kazakhstan citizen who crossed Russia's border illegally, was imprisoned there, and later joined the war in Ukraine, Orda.kz reports.
In its official reply, the KNB stated that it cannot disclose full details of the criminal case due to legal restrictions.
Information obtained during investigative and operational procedures remains confidential.
Information on criminal cases about the participation of Kazakhstanis in armed conflicts on the side of foreign states is confidential within the investigation, the KNB said.
Still, the response suggests that an investigation is underway.
The individual could face charges under specific articles of Kazakhstan’s Criminal Code. The main charge, under Article 172 (participation in foreign armed conflicts), carries a prison sentence of five to nine years.
A second charge, Article 392 (intentional illegal border crossing), could result in up to one year in prison — or up to five years if committed as part of a group.
It remains unclear whether Kazakh authorities will seek the individual’s extradition.
In April, reports surfaced that two Kazakhstan citizens had illegally crossed the border into Russia hidden in a coal wagon.
Russian border guards detained them in the Kurgan region. The men claimed they were fleeing charges of separatism in Kazakhstan. Both were imprisoned for the border violation, but one later joined the Russian military and was sent to Ukraine.
The whereabouts of the second individual remain unknown.
