Criminal Case Opened Against Sherzat Polat's Father

A pre-trial investigation has been launched against Karzhaubay Nurymov under Article 202 of the Criminal Code of the Republic of Kazakhstan: “Intentional Destruction or Damage to Someone Else’s Property,” Orda.kz reports.

Lawyer Askar Kaimakov reported this on Facebook. Commenting on the case, Kaimakov refuted the police statement that Nurymov's lawyers asked to detain him.

Activist Aitbek Amangeldy also confirmed this.

There were news reports that lawyers demanded that Karzhaubay be detained for his own safety - this did not happen. None of the lawyers stated that Karzhaubay should be detained,Amangeldy said. 

The arrest of Sherzat Polat's father became known on December 10.

According to the police, the man behaved aggressively after the funeral of his relative, threatened to commit suicide, and demanded a meeting with journalists.

Kaimakov considers Nurymov's arrest illegal.

We consider the court ruling, which sentenced Karzhaubay to 15 days of arrest, to be illegal (the court committed gross violations), and we have appealed it, he commented.

Kaimakov added that the relatives of Nurkanat Gaiypbayev, Sherzat’s uncle, did not give consent to the publication of correspondence before his death.

On December 10, Karzhaubay Nurymov was detained for hooliganism.

The police say the man used profanity, threatened with a knife, scratched a car, and punctured a tire.

He violated public order, creating a danger to others, including children. For the fact of hooliganism, the court sentenced him to 15 days of administrative arrest,  the Almaty Region Police Department commented.

It was established that on December 10, in the village of Azat, Yenbekshikazakh District, material damage was caused to the owner of a car, which significantly exceeds the threshold of administrative liability and entails a criminal qualification of the act

All the details are currently being established. Police say, "offenses will be investigated objectively and impartially, regardless of the offender's identity."

The Ministry of Internal Affairs announced yesterday that the investigation into the Sherzat Polat's homicide would be completed by the end of the year.
