Bishimbayev: Appellate Court Reviewed Parental Rights Case

In Astana, the appellate court reviewed the case of depriving convicted former Minister of National Economy Bishimbayev of parental rights. His ex-wife, Nazim Kakharman, requested this.
Bishimbayev spoke online:
All this time and after the first trial (during the process) alimony was paid on time. What the plaintiff (Nazim Kakharman - Ed.) is now stating does not correspond to reality. This is once again, as was said yesterday and the day before yesterday, an attempt to promote themselves on social networks and put pressure on the court. To portray me as such a scoundrel who does not even pay alimony for his children <...> Similarly, my children's education is paid for by my parents, they do this at my request, within the execution of the alimony agreement. If necessary, all documents will be presented. As for the power of attorney, my authorized person said that during my pre-trial investigation, after I was taken into custody, not once did Kakharman's lawyer or she personally transfer documents on the need for a power of attorney or a change of surname in any legally accessible way. After the first trial, as soon as she filed for alimony, I signed the documents. If it is in the children's interests and will allow them to feel more comfortable in social life, I am all for it. said Kuandyk Bishimbayev.

He also added that a power of attorney for traveling abroad was incorrectly presented; it contained requirements for granting Nazim Kakharman all parental rights, with which Bishimbayev disagrees.
Kakharman, in turn, stated that procedural violations were committed in the court of first instance:
All of Kazakhstan and people beyond its borders know the details of the so-called 'Bishimbayev Trial' and the tragic death of Saltanat Nukenova. Can a person who committed such an inhuman and cynical crime be called a father, influence children, and have claim to any parental rights? In our opinion, the answer is obvious! Under no circumstances can such a person have the status of a father and parent, she emphasized.
Kakharman says the court’s decision did not consider the children's opinion, who considered Saltanat Nukenova a family member despite the absence of an official marriage.
The children loved Saltanat as a family member, not because of a passport stamp. The court took a purely formalistic position, which is very dangerous in terms of future social consequences. If Saltanat Nukenova had a marriage certificate, he would definitely have been deprived of parental rights,
said Bishimbaev's ex-wife.
The appellate board upheld the decision made by the court of first instance.
Kakharman was married to Kuandyk Bishimbayev for 14 years; they have three children.
In September of this year, the court of first instance refused her request to deprive her ex-husband of parental rights. The grounds could have been the commission of an intentional crime against the life or health of family members.
The court based its decision on the absence of a registered marriage between Bishimbayev and Saltanat Nukenova.
