Ten Days: Period for Recognizing Organizations as Terrorist or Extremist to Be Shortened

The period for recognizing organizations as terrorist or extremist in Kazakhstan will be reduced to ten days, Orda.kz reports.
The Senate approved the law “On Amendments and Supplements to Certain Legislative Acts of the Republic of Kazakhstan on Matters of Reforming the Judicial System and Improving Procedural Legislation.”
According to Nurserik Sharipov, Chair of the Civil Division of the Supreme Court, the new law implements amendments to the constitutional legislation President Toqayev signed in the summer of 2024.
Among the innovations is the reduction of the period for considering cases on recognizing organizations as extremist or terrorist to ten days. As Supreme Court judge Nuria Sisenova noted, this is crucial for the country's security.
The fact is that this is related to the security of the country, so it was necessary to shorten these terms and consider such cases within ten days, noted Nuria Sisenova.
Another vital new aspect is the creation of cassation courts.
The President raised this topic at the IX Congress of Judges. Nuria Sisenova emphasized that currently, in the cassation instance, a judge decides whether to transfer the material for consideration. Under the new law, this stage will be excluded, and judges will collectively consider whether there are grounds for reviewing the judicial act.
Let's say that now in the court of cassation, in order for a petition to be considered by the full panel of judges, it is necessary for one judge of the Supreme Court to study it and make a ruling that the case is subject to review. And then transfer it to an extended session of the panel. Or they can single-handedly refuse to review. Then a person is satisfied only with the fact that one judge declined. We considered that this is not entirely correct, that the case should be considered collegially by three judges to objectively and fairly understand the arguments of the petition, added Nuria Sisenova.
