Peru and Kazakhstan Agree on Extradition of Suspects and Convicted Offenders

Kazakhstan’s Mazhilis has approved three draft laws ratifying criminal justice treaties with Peru, Orda.kz reports.

The treaties cover mutual legal assistance in criminal matters, the transfer of sentenced persons, and extradition.

The mutual legal assistance treaty provides for cooperation between the two countries’ law enforcement agencies in the investigation of crimes. It includes information exchange, locating persons, searches, interrogations, expert examinations, the collection and transfer of evidence, and other procedural actions—within the framework of the parties’ national legislation.

The treaty on the transfer of sentenced persons allows citizens of Kazakhstan and Peru who have been sentenced to imprisonment in the other country to serve their sentences in their home country. This applies to individuals who have already been convicted and who consent to the transfer, provided the established conditions are met.

The third treaty regulates the extradition of persons wanted for criminal prosecution or for the enforcement of a final court judgment. Extradition is possible for crimes punishable by at least one year of imprisonment. The treaty also clearly sets out grounds for refusing extradition, including if the offense is political in nature or if the request is linked to discrimination based on race, nationality, or religion.
