Dolgalev Case: Court Renders Verdict

Director of the Obukhovsky Mining and Processing Plant Viktor Dolgalev, his son Danil Dolgalev, lawyer Sanat Kurmanbaev, and Astana businessman Timur Sadvakasov have been sentenced to prison, Orda.kz reports.
The trial in Pavlodar was held with a jury, which returned a guilty verdict. The court announced the sentences based on that verdict.
Viktor Dolgalev was found guilty under Articles 334, Part 3, Clause 3 (unauthorized use of subsoil resources), 214, Part 2, Clause 2 (illegal entrepreneurship), 24, Part 3 (preparation and attempted crime), and 367, Part 3 (bribery) of the Criminal Code of Kazakhstan.
By absorbing the lesser sentence into the more severe one, Viktor Dolgalev is sentenced to 11 years’ imprisonment with confiscation of property, a lifelong ban on holding public office, and a seven-year ban on engaging in entrepreneurial activity in the subsoil sector,
the court said.
His son, Danil Dolgalev, was convicted of unauthorized use of subsoil resources and illegal entrepreneurship. He received six years in prison with confiscation of property and a seven-year ban on business in the subsoil sector.
Under the Law on Amnesty for the 30th Anniversary of the Constitution, his sentence was reduced to four years, nine months, and 18 days, though confiscation and the business ban remain.
Lawyer Sanat Kurmanbaev was sentenced to 10 years’ imprisonment with a lifetime ban from public office under Articles 28 (incitement to commit a crime), 367 (bribery), and 190 (fraud). Businessman Timur Sadvakassov received the same term and property confiscation under the same charges.
Viktor Dolgalev was tried a second time on nearly identical charges for which he had previously been acquitted. This time, investigators added an attempted bribery charge, while his lawyer and associate were also accused of fraud.
The Anti-Corruption Service had previously stated that neither bribery nor fraud occurred. Sadvakassov’s family presented documents claiming to prove his innocence, but despite this, the defendants were sentenced to prison terms.
